Regulations Under Act 852 A Game Changer In Anti-Smoking, Anti-Vape Efforts — Azrul Mohd Khalib

The Galen Centre describes the enforcement regulations under Act 852 as a "game changer" in anti-smoking and anti-vaping efforts, two decades after 2004 tobacco control regulations under the Food Act. Vapes/ e-cigs are now treated similarly as cigarettes.

Vape Devices Must Meet MOH Rules For SIRIM Approval

Act 852 doesn’t list "vape device" as it falls under KPDNHEP, but it bans the sale of imitations of tobacco products, and treats vape devices and liquids as one. Disposable pods can't be shaped like toys or food. SIRIM-registered vapes must meet MOH rules.

Government Mandates Graphic Health Warning Labels On Vape Packaging, Limits Nicotine Content

Act 852 mandates health warnings on the packaging of both nicotine and non-nicotine vape products. The required label states: “Smoking products cause lung disease”. Vape nicotine content also limited to 35mg/ml now, then lower to 20mg/ml from Oct 1, 2025.

Tobacco/ Vape Regulations Enforced: Bans On Retail Display, Online And Vending Machine Sale

Act 852 is finally enforced. MOH has imposed a retail display ban on cigarettes and vapes except in specialised stores; and a ban on online and vending machine sales of smoking products. The retail display ban will come into effect latest by April 1, 2025.

Manipal Alumni Association Malaysia says that strict enforcement of Act 852, which takes effect on Oct 1, must be supported by public awareness campaigns about the harms of vaping, particularly for students. The group also suggests revisiting the GEG.

MOH says a mall in KL followed its advice in a visit to close down a vape vending machine as a "social responsibility". MOH also says Act 852 regulations, which are currently being drafted, include proposed prohibitions on tobacco/ vape vending machines.

The Galen Centre is disappointed that the government broke its promise to earmark half of vape liquid tax revenue for health, with all the funds going to the Federal Consolidated Fund instead. The earmarking was pledged in exchange for not banning vape.
