Court Denies Anti-Tobacco Bid To Suspend Liquid Nicotine Delisting

The High Court has denied an application by anti-tobacco groups to stay the health minister's order exempting liquid nicotine from the Poisons Act; the judge said applicants needed to show "special circumstances" for a stay. Case hearing is set for Dec 6.

The High Court grants leave to MCTC to pursue judicial review of the Health Minister's order exempting liquid nicotine from the Poisons List. However, the government opposes the stay bid over the order, arguing that taxation is a form of control on vape.

Medical Mythbusters Malaysia (M3), the Malaysian Medical Association, and the Malaysian Pharmacists Society support MCTC’s judicial review application challenging the delisting of liquid nicotine. M3 says it's appropriate to "bring this matter to justice".

The Malaysian Council for Tobacco Control wants Health Minister Dr Zaliha Mustafa to reinstate liquid nicotine into the Poisons List before the July 26 hearing of their judicial review application against the delisting, instead of fighting them in court.
