KUALA LUMPUR, July 25 — A woman’s lawyer told the police to investigate a “stealthing” case against her client instead of referring it to the religious authorities.
Lawyer Serene Lim told Malaysiakini that “stealthing”, where a man secretly removes or damages his condom during sex, was considered rape in some countries, though stealthing is not explicitly prohibited under Malaysia’s Penal Code.
“If you look at the Penal Code, there is something that says ‘misconception’. You are giving a misconception by saying you are going to do this and that, to obtain consent,” Lim was quoted saying.
“So in a way it is not genuine consent that is obtained, because consent is given based on a misconception.”
She reportedly said stealthing is underreported in Malaysia.
Kajang police reportedly decided to refer Lim’s client’s complaint to Jais. The woman’s police report against a foreigner, complete with her unredacted phone number and house address, has gone viral.
Lim urged the public to stop sharing her client’s police complaint.
“The harassment through her phone is insane, by now she must have gotten hundreds of them.”
